Warehouse - the main warehouse is located in Mściszewice 83-321, Strażacka 3.

It operates within the Warehouse Complaints and Returns Department, which is located in the warehouse in Mściszewice 83-321, Strażacka 3. handling complaints, statements on withdrawal from the contract and a statement on the return of the product after the deadline for withdrawal from the contract. Shipments should be addressed to the Warehouse address indicated above.

Kapeo Laser Online Store - operated by the Online Store, available under the domain www.kuto.pl as well as other functionalities made available on the website www.kapeolaser.pl.

Cart - functionality of the KAPEO Laser Online Store in which the products selected by the Customer for purchase are visible, as well as the determination and modification of order data, in particular: the number of products, delivery address, invoice data, delivery method, payment method.

Product site – a site in the kapeolaser.pl Online Store on which information on the product is presented.

Customer Service Office – the Customer Service Centre available at ..... and e-mail address laser@kapeolaser.pl

§1 General provisions

    1. These Regulations define the rules for using the KAPEO Laser Online Store, placing orders for products available in the KAPEO Laser Online Store, delivering the ordered products to the Customer, paying the Customer the selling price of products, the Customer's right to withdraw from the contract and the rules for submitting and considering complaints.

    2. In order to use the KAPEO Laser Online Store, including browsing the assortment of the KAPEO Laser Online Store and placing orders for products, it is necessary to:

a.)  have a computer with access to the Internet and a web browser of the following type: Chrome, Firefox, Internet Explorer, Opera, Safari;

 b.) an active e-mail account.

3. The Customer is entitled and obliged to use the KAPEO Laser Online Store in accordance with its intended use.

 4. The Customer is obliged to refrain from any activity that could affect the proper functioning of the KAPEO Laser Online Store, including in particular any interference with the content of the KAPEO Laser Online Store or its technical elements, including the provision of illegal content. It is forbidden to use the KAPEO Laser Online Store for purposes other than its intended use, including in particular sending spam, conducting any commercial, advertising, promotional activities on the websites of the KAPEO Laser Online Store, etc.

§2 Rules for using the KAPEO Laser Online Store

1. Logging in to the KAPEO Laser Online Store is done by entering the e-mail address and password provided when registering the Customer's account in the login form, as well as accepting the regulations of the KAPEO Laser Online Store.

2. The Customer who has registered (created an account) in the KAPEO Laser Online Store may use all available functionalities of the KAPEO Laser Online Store, including placing orders for products available in the KAPEO Laser Online Store assortment.

3. The Company is entitled to block the Customer's account if its operation within the KAPEO Laser Online Store violates generally applicable provisions of law, the rights of third parties (including in particular the rights on intangible goods), personal rights of third parties, the principles of social coexistence or the provisions of these regulations. The Customer will be notified about the intention to block the Customer's account to the e-mail address currently registered in the KAPEO Laser Online Store.

4.  The Company is entitled to remove from the KAPEO Laser Online Store Materials containing illegal content, violating the rights of third parties, personal rights, rules of social coexistence or the provisions of these Regulations. The Customer will be notified of the intention to remove the Materials posted by the Customer to the e-mail address currently registered in the KAPEO Laser Online Store.

5. The Customer is obliged to keep confidential:

login and password to your account in the KAPEO Laser Online Store, because they verify the identity of the registered Customer in the KAPEO Laser Online Store.

6. The Customer has access to its orders history. 

7. The Company is not be liable for any possible damages resulting from the provision by the Customer of false, outdated or incomplete data resulting in non-compliance with the terms of these Regulations. The data provided by the Customer may not violate the provisions of the currently applicable law and personal rights and rights of third parties.

8. The Company reserves the right to change the amount of delivery costs, in particular

in the event of a change in the price lists of services provided by entities performing deliveries. This provision does not apply to orders already executed.

§3 Information about the products

    1. Information about products available in the assortment of the KAPEO Laser Online Store

    2. Prices of products indicated on the website of the KAPEO Laser Online Store:

a.) do not include delivery costs. The delivery costs depend on the method of delivery of the product chosen by the Customer, as well as on the value and size of the order. The delivery costs are given when choosing the method of delivery of the product by the Customer. The total cost of the order (i.e. the price of the products together with the costs of delivery and the costs of additional services, if such is provided by the Company and is selected by the Customer) is indicated in the basket before the order is placed by the Customer.

§ 4 Terms of the orders execution 

    1. The Customer may place orders for products available in the assortment of the KAPEO Laser Online Store as a registered Customer (after logging in to the Customer's account).

  2. To place an order:

a.) select the product that is the subject of the order, and then click on the "Add to cart" (or equivalent) button, and if you want to purchase several products, this action should be repeated for each of the selected products;

b.) after completing the product selection process, go to "Basket", and then:

– choose the method of delivery of the product and, if the chosen method of delivery of the product so requires, the type of shipment;

– in the event that the order is delivered via the Courier Company: enter the data of the recipient of the order and the address to which the product is to be delivered. If the courier company is chosen, it is required that the Customer additionally provide a telephone number to contact the courier;

– enter the data in the invoice if they are different from the data for receiving the order;

– click the "Order and pay" or similar button;

3. In the case of prepayment, you must also pay the order in one of the available payment methods.

4. The subject of the order can be delivered to the Customer – depending on its choice and the size of the ordered products:

- to the address indicated by the Customer in the order – by the Courier Company, if the Customer has chosen this form of delivery;

 5. If, as part of one order, the Customer orders at least 2 products, the order may be divided by the Company into at least 2 (two) parts (hereinafter referred to as "Packages").

6. In the event of the lack of the ordered product in the Warehouse or the inability to execute the Customer's order for other reasons, including if the purchase of the ordered product from the Company's suppliers is not possible within the time provided for the order, the Company will inform the Customer about the situation by sending a message to the e-mail address indicated by the Customer.

7. When placing an order and choosing a delivery carried out by a courier company, the Customer should provide the exact address at which the order is to be delivered. Providing an incorrect or inaccurate address by the Customer may cause a delay or prevent delivery of the subject of the order.

§5 Forms of payment and commencement of the order

    1. Delivery of the subject of the order is possible in Germany through one of the courier companies.

2. Payment for the order should be made before the collection of the subject of the order (payment in advance) - by bank transfer, payment card or using the Blik, Przelewy24, PayU mobile payment system, in one of the electronic payment systems accepted by the Company at the time.

§ 6 Issuing and delivery of invoices

The company issues VAT invoices in the form of E-Invoices. If the purchaser wants to receive an invoice, it must provide the data for the invoice together with NIP in the order. Invoices shall be sent in electronic form. Acceptance of these terms and conditions means consenting to receive such invoices in electronic form by the purchaser.

§ 7 Order execution deadlines

Shipments are sent on average within working days and within the maximum working days. Goods displayed and available in the store are physically in our warehouse. There are, however, exceptions when the goods available in the store are not available in the warehouse. In this case, the order receives the status of "temporary lack of goods". Usually, stock shortages are replenished up to 5 days. In this case, please contact us in order to decide on the further processing of the order (resignation from the order, sending what is in stock or waiting for everything to be available and then shipping). 

NOTE: we do not send to post office boxes!

§8 Complaint procedure

1. The Company is obliged to provide the Customer with items without defects. The Company is liable to the Customer if the sold product has a physical defect, we replace the goods with another, functional or repaired. In order to file a complaint, it is necessary to send the claimed goods to the warehouse to the following address: ul. Strażacka 3, 83-321 Mściszewice with a completed complaint form and a copy of the proof of purchase (invoice).

2. The Company will respond to the Customer's complaint within 14 (fourteen) working days from receiving the complaint.

3. The Seller is not be liable for damages resulting from the use of the used consumables. In the case of a complaint, it is liable for damages only up to the amount of the cost of the material sold.

4. Complaints are not subject to consumables.

5. Every consumer may exercise the out-of-court means of considering complaints and redress. In order to apply the possibility of an amicable settlement of disputes relating to on-line purchasing, the Consumer may make its complaint via the EU's Internet platform ODR available at: http://ec.europa.eu/consumers/odr/.

§ 9 Guarantee terms

We offer a 12-month guarantee on all goods. The Customer (consumer) has the right to return the goods without giving any reason within 14 days from the date of receipt of the goods. The goods may not bear traces of use. The store reimburses the cost of goods plus the cost of shipping to the customer according to the economic postal tariff (registered letter or postal parcel). The store does not refund the costs for returning the goods to the store. A copy of the proof of purchase must be included in the shipment along with the return. A statement of withdrawal from the contract can be sent in the consignment or separately by letter. The right to return without giving any reason does not apply in the case of the purchase of goods for the company (for business activity).

§ 10 Personal data

    1. Information on personal data processed by the Company, including in particular the purposes of processing and the rights of data subjects, are specified in the Privacy Policy of KAPEO Laser.

  2. The Customer declares that the personal data provided by him are the Customer's data, as well as that these are true and up-to-date data. In the event that the Customer provides data of other persons (e.g. as recipients of the order), the Customer declares and ensures that it has a basis for providing such data (e.g. such a person has given appropriate consent), that he has informed such a person about the transfer of its data to the Company and about the rules of processing personal data specified in the Privacy Policy by the Company.

§ 11 Final provisions

    1. The solutions we sell are in most cases intended for self-assembly. These are structures and their components, so the customer must have basic knowledge of the assembly of steel structures and apply basic safety measures. 

 2. KAPEO Laser Spółka z ograniczoną odpowiedzialnością reserves the right to any modification of this website, as well as the right to refuse sales, without giving any reasons.

 3. The server administrator maintains full confidentiality of all data provided by customers, and in particular personal data in accordance with the Personal Data Protection Act. The registered customer has the full right to inspect and modify their data, including their deletion.

4. The seller and the administrator make every effort to ensure that this website is constantly available and contains true information. However, this system is used in the state "as it is today" and therefore the seller and administrator apologizes for possible errors in the information provided and for possible errors in the functioning of the store. Photos published in the store show the actual goods or similar/compatible goods and are ONLY for illustrative purposes. In the case of offering replacement materials, photos of original products may be published for easy identification by the customer, but the product description contains information whether we are dealing with the original product or a replacement – a replacement product. Always read the product description.

   5. The law applied in the Republic of Poland shall prevail over these Regulations. In connection with the increasing number of clauses not allowed in the regulations of online stores published by UOKiK (the Competition and Consumer Protection

Office), we would like to inform you that if these regulations violate the current and future clauses at any point, please consider this point as not applicable.

    6. All elements of this website, including product descriptions and photos, are protected by copyright and it is illegal to use them without the consent of the owner. The protected marks and names used in the description of the articles serve only to identify the product or its substitute.

  7. The Company reserves the right to change the Regulations for important technical, legal and/or organizational reasons, such as changing the law, the emergence of new technologies and IT systems forcing a change in the rules of functioning of the KAPEO Laser Online Store, a final court judgement, an administrative decision, force majeure. Changes to the Regulations do not violate the rights of acquired Customers, which in particular means that orders placed by Customers before the entry into force of changes to the Regulations are implemented in accordance with the existing provisions of the Regulations.
